True, that's just what it's like in an apartment building. When I lived in a duplex my neighbors played smurfing bowling in the middle of the night.

"Elements of Disturbing the Peace: It shall be unlawful for any person to:
  1. Make, continue, maintain or cause to be made or continued any excessive, unnecessary, unreasonable or unusually loud noise or any noise in such manner as to annoy, offend, disturb, injure or endanger the comfort, repose, health, peace or safety of any reasonable person of normal auditory sensitivity residing in the area.
  2. Use, operate or permit the use or operation of any electronic device, radio receiving set, television, musical instrument, phonograph or other machine or device for the producing or reproducing of sound in such manner as to disturb the peace, quiet and comfort of any reasonable person of normal auditory sensitivity inhabiting the area.
  3. Congregate because of, participate in or be in any party or gathering of people from which sound emanates of a sufficient volume so as to disturb the peace, quiet or repose of any reasonable person of normal auditory sensitivity residing in any residential area. No person shall visit or remain within any residential dwelling unit wherein such party or gathering is taking place except persons who have gone there for the sole purpose of abating said disturbance. A police officer may order all persons present in any group or gathering from the dwelling unit to immediately disperse in lieu of being charged under this Section."


It's really a myth in most places that noise ordinances go into effect at a certain time.

OP said he has loud music playing every night until 2am, that's not working night shift.... Night shift is typically 10p-6a/ 11p-7a something like that. Just the impression I'm getting is a single guy, who stays up late and sleeps all day- from the sarcastic tone he gave her and everything. I don't see how a parent can sympathy with this guy. Yes sucks if the baby really does keep him up all night, but you can't really control the baby and the crying.. That should be forgiven unless it was a case of neglect and the baby cried 24-7. The music can be controlled, if you live in an Apartment.. You shouldn't purposely be loud, it's disrespectful. That's just how I'd feel about it.

Seriously! Do people expect to have perfect neighbors 24/7 who will accommodate to what's going on in THEIR life? I'll be damned if I have a baby and go next door and ask them to keep their 10 year old son from wandering the hallways and talking because it disturbs my baby. Or ask my neighbor to turn down his music because I don't like hearing my glass shake. GTFO here.

She is quiet between midnight and 730 to 8am so idl what he is talkimg about. She ia not a cry all the time baby. Lol My Dh is the police. I was just mad about how rude he was.

I don't think you got the whole point that she simply asked and he was rude about it. It's late and their is a baby beneath him it's common courtesy. I lived in an apartment for a long time and I respected my neighbors and they respected me period the end. If he didn't have an attitude different story, I would call police.

Yes, I do expect to have considerate neighbors because I am considerate to them.

If he's working that schedule, that means his body is used to being up this time of night. And I'm sure it's not every night, just exaggerating.


You can't blame a baby for the noise. You chose to have the baby, chose to keep it... whatever the situation. Just like he chose to play the music. All life choices -- deal with it.

Lol then clearly... if he is doing this every night like you say and your DH hasn't done anything, it's not illegal

I did nothing of the sort. They are loud all the time. I never say smurf. Tonight we are all sick and the baby is running a fever excuse me for wanting some peace one night

I'm very non confrontational. They were loud constantly and their kid would run up and down the hallway singing at the top of her lungs. I just turned up the volume on my tv to drown them out. It really wasn't that horrible. I got used to it. They were super nice and I would have hated to create bad blood.

Nobody is telling him he can't be awake, she didn't tell him to go to bed she asked him to turn his music to a considerate level.
