Court Ordered to Have No More Children or Face Jail. WDYT?

So this woman left her 2 children (age range 2-11) in a hotel room on Halloween so she could go out as party.

One child has severe mental and physical disorders. And one of them (I'm not sure which) was found upside down, strapped in a stroller in the room.

The mother was convicted of 4 counts of child abuse (I think something else as well) and was sanctioned in a dozen ways (no jail time) including not being allowed to have anymore children for the remainder of her probation which will be 13 years. If she does get pregnant in the time period she will have to go to jail for 5yrs.

This ruling was the result of a plea bargin. She chose between 36 months (I believe) of hard jail time or the above sentence (I can't remember all the stipulations of her probation) and this is what she chose to do over jail time.

Now the woman has a new boyfriend and is wanting to have another baby so her and her lawyer are appealing the decision.

What do you think about this? Is it a fair ruling? Should it be overturned? Is it illegal?


The ruling also stipulates that in so many years if she can prove she's rehabilitated and is a fit mother she can have children before the 13yrs.



I think this is a fair, legal ruling only because it was a plea bargin and she made the choice to accept it. It wasn't just a ruling bc he was convicted. Otherwise I might not think the same even though I don't think she needs more children obviously.

I wish they could invoke the no children rule on so many parents that are out there.... But is it legal? Not to any law that I have ever heard.

I think it's fair although I'm not sure about the legal part...I was not aware that a judge could prohibit someone from having children.

I think its a good sentence & I think more people should be ordered not to have kids.

Human rights is being able to reproduce. They cannot take that away.

I obviously don't know everything to the situation. I am sure there was more then just this incident that help the judge decide his verdict. So, I am not sure.

However, I don't like the thought of a judge having rights to someone else's reproductive organs.

A court ordered my SIL to not have any more children after all 5 of hers were re-homed. In PA. Still not sure how that is legal, but it DID happen.

ETA: she has mental issues, maybe that's why

I wish they could to but I think it would get out of hand and create a whole new sort of craziness!

The only reason I think it's legal and will stand is bc she heard the stipulations of the agreement and agreed to it. She didn't have to.

The fact that she agreed to it makes me feel like it should stick. I could understand an appeal if the judge gave her no choice. Or if she decides she does not want that stipulation anymore doing the time in jail that she would have gotten had she not agreed.

If she agreed to it, that is on her.

I think it was TOTALLY called for and I hope to GOD they don't overturn it because she does NOT need any more children if partying on halloween is more important than her young children, let alone a disabled one!!!

I'm always caught in this situation, while I don't agree that a judge should determine if someone is allowed to have any more kids or not- I think that after so many charges of child abuse, that maybe it's in the best interest of the unborn child.

I also know that people (like my sister) should never be able to have children, because she would attempt to sell her/give her away for another hit of meth. I mean... I wish there was a way to determine smurf like this, but there is no easy answer.

I think its fair. People shouldnt have kids that they are going to neglect.

My SO's ex had so many kids taken away that the state said if she had another that he/she would immediately go into states custody.
