California court

posted 8th Jan
Okay so I'm not going to go into to much detail cause honestly I'm embarrassed by the amount of stupid drama involved but I need help..
I am supposed to move to south Carolina in a week,I had my daughter on Saturday.
On Thursday of last week I got a call from many ex's( baby daddy's) cousin letting me know that he was taking me to court and we had a hearing Friday. At the hearing Friday the judge ordered a paternity test and said I'm not to leave the state until after our hearing on the 14 th. Here's my questions...
Can a judge order you to remain in a state when no paternity is established?
Since he has to pay for the test and I have yet to hear from him will that make the judge throw out the case??
I know thay I may sound like a b**** but he hasn't been around my entire pregnancy, when we were still together he got his ex pregnant again and come the end of February he'll have 3 under the age of one with no job, no car, still living with his mom and 5 brothers. I know him and he sees me trying to move on with my life, going back to school and following my dreams and getting out of California and thats the only reason he is pulling things court bs. to try to force me to stay here.
Any other tips for court I'd really appreciate. when I went with by ex husband we never really fought we always had IR worked out.

Btw sorry if this seems scattered I'm stressing

Yes the judge can order you to stay until the test is taken.

If he ends up not being the father then the judge cannot order you to stay. But at the same time if the father does step forward and want to be in your childs life, you can and prolly will be ordered to move back to Cali.

As far as I know, yes a judge can order you to stay in CA. And if he won't get ahold of you you need to get ahold of him and if that doesn't work, document each time you try. And I would try every day. But you still can't leave until the judge says so.

Sidenote...I can see why you would want to leave CA if you live in Hesperia. I have family up there in the High Desert.

Yep. But I believe you can be a certain number of miles apart. My friend and his BM are exactly 900 something miles. The judge told her 1000 miles and thats it.
Thankfully he works for airlines and can fly to get his daughter and she stays for a certain amount of days.

I have, everyday since Friday after court, but I can only get a hold of him via facebook, its showing that he's reading the messages but he's not responding. I'm just stressed out, I quit my job instead of taking maternity leave, I have given my 30 notice on my apartment which is up on the 20th and its already been rented. and I'm signed up for school in SC have a 3 bedroom house waiting for me and a job childcare and got custody of my older kids back... my life is on track as long as I can get out of here

It's not your job to get ahold of the man. Go to your hearing on the 14th and see what happens from there.
