Canadian father, American mother. PLEASE HELP!!!!!

Okay, my husband of 2 years has recently cheated on me.
We are MARRIED. with a son.
I am from New Hampshire, USA and he is from Ontario USA.
He's been cheating for a month. I want to take my son, pack up and go home!
Do I have the right to take him if father says no?

There is absolutely no proof that my son is a canadian citizen but I have proof he is a citizen of usa, and we told the border we were only visiting, not moving.

How long have you been in ontario for? Where was the child born?

Your also living illegally here to so be carful about getting a lawyer in Canada..
