Do you have any of the abuse documented, say through the police?

Go to a shelter. Then call a lawyer. I would think that because your son is not a citizen, and I assume you aren't either, a judge would allow you to move back home if you divorce. But you need to make sure.

Then go to the police and file a RO. Then go home. But you need to contact a lawyer to get it taken care of.

If thats the case, you need to contact the CAS the childrens aid society. They will pay to get everything done in a legal way, so he cant turn around and charge you with kidnapping.

This sounds like your best bet, OP.

You need to go to them and explain to them that you're being held there against your will and that he is abusing you so that you have documentation that he is abusive and documented reasoning for overstaying your 1 month.

That's kinda stupid. Very stupid.

That might complicate things. I'd suggest going to the shelter and contacting the police. Tell them that your husband kept you there.

Yup basically this. You need to get something documented or else it's just your word against his. Also should do it the legal way.

That's kind of sad, a child has nothing to do with his/her parent cheating and shouldn't be punished.

It is the best option. I know from watching someone go through something simular to this situation.

OP seriously call the CAS department near you, call anomisouly (sp?) lol and ask them questions. Say you know someone who is in this situation etc....how should they go about handling it. Can they help you and so forth.

If it were me in the position, which I can't say this is right, but I would just pack up and leave when he is at work and never look back.

If he wants to press charges, he would have to find me and I would get a lawyer here for it once it goes through.

But that's me.
