I wouldn't leave my 13 month old in a tub by themselves. If I ever leave my son it's for seriously 1 second to run maybe 8 ft away to the towel closet to grab a towel.

Parent is at fault. The parent should be charged with Child endangerment and possibly manslaughter.

Um yes the parent should be charged for negligence that resulted in death idk im not good with law terms but the parent should definitely be charged.

My DD is 12 months old and I never ever leave her in the tub alone.
Not even to get a towel, I'll yell for SO to grab one.

She should be charged, I believe with murder or something similar.
that was 100% preventable.

13 months is too young to be unattended, that is a case of negligent parenting.

so sad, and more sad that this kind of thing happens so often.
it was an accident, but she was also negligent. she should be charged with negligence and manslaughter, though i'm not sure of a punishment worse than living with that kind of guilt.

No IMO she should not be charged. It's a terrible tragedy and it could have been prevented. I'm sure the guilt and knowledge that her momentary absence was the cause of her child's death is enough punishment for a lifetime. Parents make potentially fatal mistakes all the time. Would you prosecute a mother who didn't anchor her child's dresser to the wall?

Regardless of her intentions you should NEVER leave your child unattended.
