Its the parents fault, of course. She walked out of the room to act like a little kid and get on FB instead of tending to her child. Sure, it was an accident but the accident could have been avoided if the mother would have been doing what she was suppose to be doing.

WTF? Who leaves a one year old alone in the tub for ANYTHING? DS is 20 months and I don't even leave him in the tub long enough to grab a towel. If I forget to grab one I let him be cold outside the tub for 2 seconds while I grab one. I'd rather him get a cold than drown. That's sad   I would definitely say that was the parent's fault.

Quoting MommaSav2:" No IMO she should not be charged. It's a terrible tragedy and it could have been prevented. I'm sure ... [snip!] ... make potentially fatal mistakes all the time. Would you prosecute a mother who didn't anchor her child's dresser to the wall?"

Not the same.

Quoting Blaine Edwards:" *sigh* so sad, and more sad that this kind of thing happens so often. it was an accident, but she ... [snip!] ... be charged with negligence and manslaughter, though i'm not sure of a punishment worse than living with that kind of guilt."

I agree.

Ok. But I can't imagine the amount of guilt this mother is going to live wih for the rest of her life. I think that's enough and she doesn't need to be prosecuted in my opinion.

Yes she should be charged with negligence. That's like me leaving my 13 month old play outside next to a busy street and just go inside to sit on the computer. It's the same thing. There should of been supervision as it's a dangerous situation.

She is guilty of negligence. That alone needs to be prosecuted.

She should be charged. It was absolutely her fault.

It's negligence. Anyone with half a brain knows you don't leave a baby in the tub alone for any amount of time.

in this case, yeah, she should be charged with something.

If her 8 year old were to slip in the shower and hit her head or something, then that would be an accident.

For sure. I'm sure she does feel guilty, as she should, but she is still at fault. Her child didn't slip and fall into a pool and drowned. She drowned because her mom felt that FB was more important for whatever reason. That type of negligence needs to be addressed. I just don't know how it should be addressed.

Quoting тᴀỵ 26:" I was reading a story about the death of a 13 month old. Apparently the LO was in the bath and the parent ... [snip!] ... away. Is the parent at fault or is it purely an 'accident'? Should the parent be charged, if so, what should the charge be?"

It is the parent's fault and she should be charged. Who the eff leaves a 1 year old unattended in a tub of water?
