Would it be ethical? *Child support*

So, here's the deal.
BD got arrested for not paying child support 12/5. I got a check from his bail (It's my first child support payment) for $1,309 on Saturday, so I deposited it into my bank account today.
Me and my mom have been talking this entire time about taking the money from child support, not using a penny of it, and depositing it into LO's savings account and having it rolled into a 5 year CD to accumulate more interest so he'll have more money for college.
Thing is, DH didn't get paid very much because he didn't work hardly any last week (Because of Christmas eve/day). I need to buy my books for next semester, class starts January 7th.
Would it be 'ethical' for me to use maybe $100 out of the $1,309 towards my school books and just deposit the rest into LO's savings? I can replace the money in February, or if it's just completely unethical I won't do it. But we are also in the financial spot we are in because the cost of LO's daycare went up and I just paid it today...
Yay or nay?

It's fine. Think of it this way.

If BD had paid the support on time, you wouldn't have had to spend that extra $100 on LO.

That $100 is going for an education which will help you get a better job, thus helping LO in the long run anyways.

Yay. The child support is still going to something that will benefit the child...the mothers education, which will in turn make a better life for the child. IMO anyway

That's what I was thinking.
I really don't want to take ANY of the money, I really want to deposit it all and go ahead and roll that plus the amount he has now into a CD, but I reaaaally need to get those books and if I use all of the money we have from DH's paycheck, we will be broke very soon and probably won't even be able to make it to the next paycheck. He works part time, minimum wage.
I can replace it in February and put it into his savings though, I'm sure of that.

You already spent 100% of YOUR money on your LO, so BD is just paying you back his 50% of LO's costs. It's completely fine to use $100 on books for your education because you would've used your money if BD had given you the money in the first place.

Well, how have you been providing for LO while BD wasn't paying child support? Obviously you and DH were covering everything. So I say yay.

Lol, it's always been a struggle but thus far, we've provided everything for LO.
I guess I just feel guilty for needing it. I mean, that's all me and my mom have talked about, rolling it into a CD to accumulate interest so he'd have money for college. I don't want to make it a habit, for sure. But it's just a smurffy time of year I guess, DH lost hours because of Christmas Eve/Day and is losing hours again for New Years Eve/Day.

Nothing unethical about it. You need an education, and that education will in turn give you a better career which will give your LO a better future. Don't beat yourself up over it, as long as your LO is well provided for, $100 on books for school is NOT a big deal.
