SSi and child support

This question is actually for my cousin...
She lives in Arizona and her "baby daddy" only receives social security disability because of a head injury.

Since that is his only source of income, she says the courts will not make him pay child support because he only has so much for himself..

Is that how it works?

I'm not sure about SSI but I know when my baby daddy quit his job and got unemployment trying to get out of paying c.s. they took it out of his unemployment checks lol

They should take his child support out of his SSI.

My grandfather received ssi and they gave additional money for his dependent children. So she should contact them and find out.

SSI is protected from Garnishment, with the exclusion of Child Support. So yes, they will take it out of his SSI.

They count it as income and would take CS out of it

I thought with disability, a child also received a check until they were 18 years old regardless. It isn't really child support from the father, but support from the government. I know someone who got a large back pay because his father received disability for years without him getting a check. Finally it caught up and the Social Security Administration cut him a back pay check.

If the father is on disability then the child should recieve a check of its own BUT the father (or maybe the mother can) has to add his dependent children to the case. There are two types. My sister is going through this her BD recieves disabilty and choose not to put his children on there so they don't recieve anything. I would tell her to call and check about what she can do.

`Yea my mil is on disability and my bil that is 10 gets a check too because of it.

i actually went through this.. ex was getting SSI (NOT SSDI) which are two different things.. ssdi you have to have a work history ssi you dont.. and with ssi they wont touch it.. its like if he was getting cash aid they wouldnt touch it..
