Learn the law, smurf

First, a few days after my ex dumped me, I went to the landlady and got written permission to stay here, holding my ex to our prior agreement until his lease expires in May and I can sign my own to stay here.

Sooo there's that, which apparently my landlady never bothered to tell him, and I have no desire to let him in on.

Well, he decided he wants a new family with the chick he cheated on me with, so he's going to break his lease. The landlady actually isn't allowed to do that, since he doesn't rent out bedrooms, he and our roommate rented the whole house and split rent 50/50. So allowing him to break the lease illegally breaks hers as well. Actually, allowing me to sign a temporary lease broke both their leases in the first place.

So he decided this this past week. He told me on Dec 19th I need to be out Jan 3rd.

Now, even if this manages to break my agreement with the landlady, which I'm pretty sure it doesn't since it says I may continue to stay as a non-rent paying guest until May 3rd and doesn't mention Michael, this still isn't legal. I've been officially, fully living here since Nov 3rd, I payed rent in Nov and Dec, and continue to pay utilities, all which I and my roommate both have records of, and my roommate has written records from the landlady showing she was aware of me staying here prior to our agreement being put to paper, which she forwarded me so I have that as well. In my state, if you pay ANY amount of money for rent or utilities and have been living in a place longer than 30 days, the LANDLADY, not the person you're staying with, has to give you 30 days notice before being able to evict you, even if you aren't on the lease.

The landlady hasn't given me that notice, and even if Michael was able to give me the notice, he gave me 15 days notice. I don't have to go anywhere until 30 days from the time I'm given notice, and my roommate has already told the landlady if she tries to give me a 30 day notice, my roommate will be suing the landlady for breaking her lease.

It's nice to know that there's someone in this damn house who doesn't think it's totally ok to kick a pregnant woman and her 5 year old out with no notice   And he STILL tries to say he's not tying to be an smurf and just kick me out. Riiiight.

Sounds like you've got the landlady, the other tennant, and the law on your side... He will figure it out eventually lol. Just look on the brightside... You will get to see his face when he figures out he just bit himself in his own ass

I have saved all the texts he's sent me too being a total dick about moving out. I specifically told him if I do leave I and my daughter have nowhere to go because HE moved me in here and told me to sublet my apartment, and I have his text that says he doesn't care if I'm on the street, as long as I'm out of "his" house.

If he tries to get full custody of our daughter as he's claiming he's going to file for, I will be making my lawyer aware of that and I'd reeeeally love to see if a judge would be ok with that.

Good! Just keep covering your ass. I have heard so many men claim they are going to file for full custody (my own brother included) and only end up with weekend visits... Unless he can prove with out a doubt that you are an unfit mother, he can file all he wants, but he isnt gonna get it.

That suuuucks! I still have some protection even if the landlady and I hadn't gotten into our own agreement. I wanted to get on the lease, I was told by my ex that I'd be signing it the night I moved in and was then given bullsmurf reasons as to why the landlady hadn't come around then. Found out when talking to her later HE told her I didn't want to be on the lease and was just going to be his guest and his responsibility.

I have a kid. Why the smurf would I move anywhere without getting legal protection for us so that he couldn't change his mind and kick us out. And I made that VERY clear to him and also have the texts we exchanged the night I moved in where I asked when I can sign the lease and he told me that night. And all the texts blaming Teresa for this crap.

Only the landlord can evict you

Leases mean significantly less than people think in most places. Sorry about your luck dude, at least you're covered as far as housing.
