re: Should Muslims be able to wear hijab in court?

Canada being the first has nothing to do with it. The fact of the matter is it's discrimination plain and simple. Men are allowed to have beards that cover up half their face, but a woman can't wear a hijab that is part of her religion?

It kinda does have something to do with it, if its such an injustice and so awful why don't other countries give a smurf? Why is it always Canada that bends rules and makes exceptions for religious freedoms?

Sigh.. She said that it would be allowed in the US and I said the only thing I can find online even regarding the hijab is people fighting to wear it in schools, a person who worked at Disney land wanting to wear it and someone having it torn off by a jail guard. Nothing about testifying in court with it.

Nobody has even had the balls to ask the US courts to keep it on, because it would never fly.

Because it has to start somewhere. Where it starts is irrelevant. You sound bitter about religious tolerance. What religion are you? Christian?

Just because it hasn't been fought for yet doesn't mean it would never be allowed. You know very little about American laws/constitutional rights. No one has challenged it yet, that's why. I bet it will come up after this case and I bet her religious rights would be respected if it came down to a Supreme Court case.

Wait....they banned the word Christmas, but have special prayer rooms for Muslims. Do they have special prayer rooms for Christians and meditation rooms for Buddhists?

No, it's not that. I just think it's getting ridiculous we have courtroom procedures for a reason. And all other religions have been separated from schools and courts why would we start making new exceptions for Muslims during the generation that's made such a point to exclude religion.

So if you're Muslim you get special treatment? How is that fair to all the other religions?

Idk about in Canada, but here in America the 1st amendment allows people to practice their religion as long as it does not infringe on the rights of others. There is nothing about wearing a hijab in court that infringes on the rights of others in the slightest. The only reason this is even an issue I think is because the extreme Islamophobia that western cultures perpetuates. Excluding religion means that the GOVERNMENT can't make laws that cater to one religion or promote one religion over another, not that citizens can't wear garments that are required in their religion. My aunt is Muslim and I'd be really pissed if she weren't allowed to wear her hijab in court.
And here in America people have to swear on a Bible before testifying...how is that fair?

Well that's exactly my point, the US is very different from Canada they would never allow someone to wear the veil when testifying. We have affirmations, where you don't swear to god or the bible, we worked very hard excluding religion and law. And then to pass a new rule that allow Muslims to walk in dressed to the nines in religious gear showing only their eyes is kind of a slap in the face for the 20 years we've worked towards separating court and religion.

And it does infringe on the rights of others, "the right to face your accuser" for instance.

And your aunt would not be allowed to wear the veil during a testimony in the United States at the present time, so I guess you can either be really mad or hope she doesn't have to testify for anything,

But separating religion from court just means that the courts themselves cannot impose religious doctrine on others, but people still have the right to practice their religion through their attire. If a Muslim can't wear a hijab then a Christian shouldn't be able to wear a cross if they're so adamant about separating the two. It is a core Muslim belief that they are not to be seen without their hijab in the company of men who aren't family, so unless the entire court is made of females they can't rightly demand her to show her face. And facing your accuser does not literally mean they have to see her entire face. Facing your accuser just means you can interrogate/question them on the stand. It does not LITERALLY mean "face" them.

I assure you, I'm not ignorant to courtroom procedures, lol. I know what it means. But a small cross or even a hooded hijab is one thing, but to have your entire face covered? My entire point about bringing up the US was because we're both western cultures and with literally 300,000,000 more people (therefore obviously significantly more Muslims) if its such an injustice how has it not been addressed there? Or was it just quickly dismissed?
