She should be allowed to wear it! It's not like she all of a sudden decided to dress like this. She's wore it all the time for the last five years. It's like making her stand naked to testify about how she was sexually abused. So wrong.

They don't use them in court anywhere in Canada and I'm doubting that they do often in the US either. Not on their testimony anyway, they only time they would use it is to analyse audio evidence such as a 911 call.

Well this one is brutal because of the sexual abuse of course, but what about in regular trials?

I think they should have to prove that they didn't just decide to wear it that day. Somehow prove a history of being that religion and wearing it all the time. She has proven that, so should be able to wear it. Are they going to make a man with a bushy mustache and beard shave it off so they can see his face? No.

Or what about someone with Bell's Palsy, or stroke? Half of their face is paralyzed. Or someone with scar tissue over their face? In court, you can't judge if someone is lying on the stand by watching their face. You have to rely on the facts, timelines, evidence, etc. , not just if you THINK the person might be lying.

Quoting Legendary Amanda:" Oh no, you can definitely tell when people are uncomfortable with what they're saying by their face. "

Not always. And of smurfing course she is going to be uncomfortable with what she's saying. She was raped...any rape victim is going to be pretty damn uncomfortable.
If facial expression were a legitimate way to tell truth from lie then we would have no need for people to go to trial and testify.

What wouldn't pass? Her being able to wear it? Yes it would. It violates her first amendment rights to not allow her to wear it.

Yeah, this case is a sexual assault so it makes it sadder, but tons and tons of woman and children get up there and testify without hiding their face. And if it's such a religious injustice why are we the first country to fix it? Canada is always the first country to go out of our way to allow exceptions for religion. We're building prayer rooms in our highschools right now, the same schools that banned the word Christmas are building prayer rooms for Muslims.

It's just crazy to me,

Show me one case where they allowed it during a testimony and I'll apologize.

When I googled it, I got one about a woman in the US who had a jail guard tear it off of her, a woman who worked at Disney land who wasn't allowed to wear it, one about a woman who wasn't allowed in a pool area of a resort and a case about not being allowed to wear it in schools.

Nobody has even fought to wear it in US courts yet, it would never be allowed.

I'm not talking about schools, I'm talking about testifying in court.
