Statutory Rape???

Hi BG moms, so I have a situation that I don't have much knowledge about so it would be great if I could get some responses with no judgement passed please and thank you ....So I am 17 years old and 4 months pregnant but I'm going to be 18 January 3. I guess the problem would be is that my boyfriend is 22 years old and my mom is telling me that he can get in trouble for statutory rape and I told her well I'm about to be 18 soon and she told me that it doesn't matter since I got pregnant when I was 17; I'm not to much worried about my mom calling the cops on my bf but I plan to move out with him when I turn 18 and I know my mom is going to be pissed when I tell her I'm leaving and try to scare me by tell me that she's going to call the cops on him so that I wont leave but the thing is ill be 18 by then. So MY main question is can he still possibly get in trouble for statutory rape even if I'm 18 by the time my mom would call the cops if she considered doing it???

Sorry if this is long and confusing AND I'm also sorry if this sounds kind of ignorant and dumb cause I'm pretty young but it would be nice if I could get some responses back...Thanks all

Age of consent is 16, so there isn't much she can do other than be pissed about it.

The age of consent is 18, with a misdemeanor if the minor has 3 or fewer years of difference with the major, and potentially a felony if the major is more than 3 years older. Penalties increase if the adult is 21 or older and the child is 15 or younger. It is automatically a felony if the minor is under 14. It is worth emphasizing that unlike some other states, the close-in-age rule in California (3 years) do not provide an exception nor provide any defense; it merely lowers the crime to a misdemeanor. Under this law, two minors of the same age could both be prosecuted.

Short answer, yes...he can be charged and your child is proof of the "crime".

I think you are safe.

The cops have bigger fish to fry. If your 18 when she wants to press charges the cops arent going to care. Plus, they might ask her why she waited so long to turn him in and why she is all the sudden changing her mind

If you're really in Cali, the age of consent is 18, so technically, he COULD get in trouble, but it's just a misdemeanor and no one is really going to give a flying smurf.

My daughter's dad got me pregnant when he was 15 and I was 16, I was a technical statutory rapist but his dad called the police and they just laughed at him.

You will be fine you are over the age ro consent. Btw if you were under the age your mom would get arrested to for knowingly allow you to be involved with him and not doing anything when you got pregnant. Its called endangering the welfare of a child. Just so you know

California Penal Code - 261.5. (a) Unlawful sexual intercourse is an act of sexual intercourse accomplished with a person who is not the spouse of the perpetrator, if the person is a minor. For the purposes of this section, a "minor" is a person under the age of 18 years and an "adult" is a person who is at least 18 years of age.

in majority of states 17 is the age for consensual sex..and if you're 18 I don't think it matters, as long as the baby is born after you're 18.
