About to Lose my Job

I have worked at my currently job since June. I was hired as a fill in and then by August I became a full-time employee. I asked my manager at that point was the position safe or could a co-worker take it from me. She assured me that only one other employee could take the position but that employee didn't want it.

Fast Forward to November. It was rumored that a co-worker wants my position. So I once again go back to my manager and she assures me that the other co-worker will only have my position during my maternity leave.

A few weeks later the co-workers come in on my shift bragging about how she is getting my spot because she had seniority over me. I was like "you were hired 2 days before me." WTF. So I go back to my manager who again says it doesn't matter the spot is mine.

Today, manager calls. She is pissed because I went over her head and talked to my owner about an issue I was having at work with her. She informs me that when I go on maternity leave the co-worker will take my spot and keep it after I return. I am then to be moved to the co-worker's shifts which I can not work. She works 7 days on 7 days off. 5:30 pm to 3:30 am. I can't work those hours with a little one at home and I am not a night person.

I am so screwed. Jobs are hard to find around here and I don't know what I am going to do. I am have been crying for the last hour. I have tried contacting my owner but she said my owner does not want us to call him unless we got robbed. IDK. I am so upset.

Isn't it up to the owner, and not the manager who gets the job/shift? I would call the owner again and talk to them.

who said the owner doesnt want calls? the manger or the owner? if its just the manager who said that she could be trying to cover her ass. call the owner and explain what happened

look up the law in your state . i know in nj when you go on maternity leave you are guarnteed your position back when you return. if not its they are breaking the law. call temporary disability and speak with them about the issue. tell them that she stated when you returned you were not going to have the same job. they will than contact your boss and she will get in alot of trouble

I tried. I left a voice mail and text him. He said he didn't have time to talk now. He will back the manager, he has never really met with me before and doesn't know me that well.

Small company. There is no HR. The owner is the final say.

im telling you! call temporary disability... also if you do speak with temporary disability and they still dont give you your job back you can sue the smurf out of them!

I work in WV and they have no laws for maternity leave. And my company doesn't have to follow federal laws because it is considered a small business. I have already looked into the legal aspect of maternity leave. I was a Business manager and learn a lot about business laws.

Apparently not. The manager has full control of the business. She is the only one in charge and apparently we aren't allowed to challenge her.
