The biggest factor is whether a father has been married to the mother of the child. If the parents have never been married the mother has the right to name or rename the child as she wishes in most states. For example, an Ohio appellate court has ruled that an unmarried father does not have the right to change the child's last name from the mother's name to his, even though he supported the child. If the parents are married or have been married, the father has the right to be notified of any proposed name change and to either consent or argue that the child should have or retain the father's last name.

No they dont. My dad isnt on my birth certificate.. its listed as "father unknown" Every state maybe diffrent.. but...Im just saying.

But becasue of my parents not being married.. He didnt have that right to even give me his last name at the time i was born.. that if i wanted it.. i would have to change it my self when i was legally of age.

I changed my daughters last name without my ex's permission. It can go by whats in the best interest of the child.

This makes me feel better. I was looking for info for my state and couldn't find anything.
But in all honesty, i dont see him putting the effort in to taking me to court anyway. But i wanted to be sure just in case.
