While this *could be* true in some
cases...you'd have to be a crackpot judge to compare this to hitting a kid if it is like he OP stated: "You're driving at night on a hwy close to neighborhoods
." I can't imagine you'd be held financially responsible even if
it was a child as there is NO reason for a child to run out onto a highway at night.....
