While this *could be* true in some cases...you'd have to be a crackpot judge to compare this to hitting a kid if it is like he OP stated: "You're driving at night on a hwy close to neighborhoods." I can't imagine you'd be held financially responsible even if it was a child as there is NO reason for a child to run out onto a highway at night.....

This. Why was the dog able to get to the road, owners fault. Happened to me back in 2009, we found the house, woke them up at 11 pm told them their dog jumped into the road out of no where, SO helped out the dog in the guys truck (he was alive) they did not ask for a penny.

This almost same scenario has happened to me, although the dog wasn't badly injured, and I told the owner to go smurf themselves. I was driving down the street downtown near homes and businesses. Speed limit was 35 I was going 30. Dog ran out in front of the car, big dog, I hit him going about 25 (no time to stop). Dog damaged the front end of the car he was so big. I got out of the car to make sure the dog was OK and his crazy ass owner came out of his house and started cussing at ME. I told him to go smurf himself, called the police who took the dog to the pound because he wasn't leashed. Wrote the owner a ticket. Then the owner's home owner insurance company PAID TO FIX MY CAR.

RE: the child situation, same thing in California. The guy up the street from us was coming off the highway onto the residential road going the speed limit. Kid on a bike rode out in front of him,he hit the child and the child and died. No laws were broken by the driver, he wasn't impaired by drugs or alcohol and he was going at a reasonable speed. No charges were made to the driver. The police also questioned why the child didn't have a helmet on as it's California state law everyone under 18 riding a bike must wear a helmet. Guy up the street was never the same, though... wouldn't drive for over a year

Man I bet, I'd have so much guilt and anxiety if I killed a kid, even if it was an accident and no fault of mine
