FMLA..Help!!

I am 7wks preg.. my husband is getting out of the army like...next month. He found a good job making good money but no medical benefits. I have been working thru a temp agency for a government office in my state. Recently, an opportunity to get a permanent job has arisen. I wouldn't technically have to work since my hubs would make good money for us, but we would have to pay out the a$$ for medical on our own. Plus, I enjoy working, knowing I am helping provide financial security and blah blah incase my husband gets hurt or something. The only reason I want this job now is to have medical benefits for our family. If hired, I would start in about a month. But my baby is due in August, and while I have worked at the same place for a staffing agency over a year, my time with the state government would be less than a year, like 6 months and FMLA wouldn't kick in because I would not have met the eligibility of working for a year for my employer. So I guess I would have no rights in taking unpaid leave and having a job when I get back, right?

Yiup, you'd have no rights regarding returning to work. That would be solely at the discretion of the employer

Technically no but if your boss likes you then you will most likely have a job when you can go back. I wasn't eligible either but I still was able to go back. Just talk to your boss and tell them your worries.

I think they might because they like me, and other people know how to do my job if I were out, but yes I guess I wouldn't have legal rights. I think since it's a state government they would be more lenient then a smaller, private employer.

I honestly would discuss the opportunity of returning to work after the baby was born with this employer you have found and the fact that you are currently pregnant. They honestly do not have to take you back after the baby is born that is their choice. You can see where they are willing to "bend the rules" for you in regards of not having been there a year to take company FMLA. My one friend dealt with this, she got her job got pregnant and wasn't there a year and they did not ask her to return.Sucks but it happens

Yea it does, I feel bad for her but her husband works so they don't have it bad at all. I had it happen with me with my first DD, I had only been at my job for like 6 months when I was pregnant and when I had my DD they sent me a letter saying that I could not return at my original rate, that I would have to start at minimum wage again. They liked me but it was a corporation and the big boss man had say I suppose.

Aw man. Well I know no matter what happens it will work out. I got interviewed for a job there that I didn't get this summer, but now the guy who got it already quit! I think my boss finally realized he wants me there perm. and now another job came up and he's pushing for me. After not getting the first one I feel embittered now so I have no high hopes for this one. If it happens, it happens. I will want short term leave but intend on coming back, not up and quitting like this guy did.

I know it sucks but at least you were offered a job when you returned. Working at min wage I'm not sure if I would have accepted it.

Nope I didn't take the job back, I told them to basically piss off. I actually took time off to be a SAHM and then went to Culinary school and got a great job while in school. lol funny how it works sometimes.
