Bd drama need some help

So I'm 18 I have a little girl that is 2 and I live with my parents. Me and my bd have been broken up for 6months and me and my new be have just been together for 3months. I haven't put my bd on child support but I told him yesterday I was going to. He said he was gonna take me to court if I did tht and he is so sure he is gonna win. He's 20 and lives with his mom, he smokes weed (i don't) drinks all the time. He use to abuse me physically when we were together and blame all our problems on me. He said he has pictures of me drinking. I work and he also works. I'm just worried about losing custody of my daughter. Since I'm underage can I get my parenting rights taken away and lose custody?

Only if you're proven unfit. Living with your parents does NOT make you unfit, though. Be prepared for a visitation schedule to be set up though, at the same time as child support(since he claims he's going after custody). If you have proof he smokes weed, and bring that up to the judge, your BD MIGHT be ordered to take a drug test, and you can ask that visitations be supervised. You really have nothing to worry about as far as your parenting rights being taken from you, though. Being young and living with your parents does not make you a bad mom.

He would need to prove that you are unfit. I could see him getting joint custody though. But courts don't just TAKE children away for no good reason.

! You're not going to lose your baby. But you may have to share her.

It depends on what state you are in as well. I see alot of people saying be prepared for joint custody. I have full physical custody of my oldest two and joint legal custody of them. Also with legal custody it says if we cannot agree then the primary custodial parent makes the final decision. And he does have to pay child support.

It's really hard to prove you unfit, even if he can prove you drink he still has to prove it hurts your ability to take care of your daughter. Otherwise he has to prove he has been the primary caregiver for your daughter
