Child support and visitation
posted 10th Dec
I know they're separate issues but once child support is set does the paying parent automatically get visitation??
DD's donor lives in Indiana and I'm in Texas. She's only 8 months so how would visitation work?? She's never met him.

No, he'd have to get them set up by the courts.
With her being so young, the first visits would be him coming to Texas to see her and once she is older, she'll go visit him.

They may or may not get visitation, it will be up to him wanting it and the judge. But usually the parent that moves away is responsible for costs/transportation of the child to see the other parent.

What if he never comes?? Would she still have to go up there to meet a complete
Stranger??

I moved when I was 28 weeks pregnant with his permission. He was supposed to follow but backed out last minute.

The 2 have nothing to do with eachother, u can pay child support and not see the baby, or like in my case I don't get child suppport and he still sees the kid...
the father would need a court order to legally see baby... u or him would have to file for vistation, then u go to mediation, u should file where u live... and if he wants visitation he can come to Court...

I am not sure how it all works completely. Just from what some friends have gone through that moved, they were responsible for making sure they got the child to the other parent or the parent to the child because they moved. If he wants visitation he will get it (as long as he doesnt have any legal issues that would prevent it) and the judge will let you guys know how it will work.

Yeah u would file where u live, if he's not asking visitation and isn't shady I would just leave it, my ex was shady and went to court without serving me and got full custody, he had never met the baby prior...
If u just want to save ur ass go to court and get full custody, it sounds stupid but that's the loop hole he used to get the baby for 6 weeks, he's not even on birth certificate...

Yes, he would have to file for that and I am not sure where he would file from to be honest. I would assume where you are but don't take that 100%.

Do I have to wait till he's on the birth certificate to do that??
Or can I do that now and then file child support etc.

Has he asked for dna test?? If he didnnt sign the declaration of paternity or done a dna test he can't file, he needs to establish paternity, to get cs from him, u would have to do that anyway because he can always pull the, *its not mine* card...
Once paternity is established he can get visitation and u will be able to get cs

Right. I know to get CS we have to do the paternity test. But should I file for full custody before I do all that?? Or do I have to wait for the results and then file??
I guess I'm asking what order to file everything in.
And just to clarify- he has to file visitation not me, correct?? I do not want him to have visitation.

No, because he'd be required to come for a certain number of visits for the child to get to know him.
