So it's safe to say I can file CS and full custody and not really have to worry about him?? I hiiiiighly doubt he'd ever file visitation. And he will never come visit. I was just scared it would get handed to him.

No u can file for cs and custody, and if he puts up a fight then they will order dna test... cs will be on hold till u get results but I believe u can still get full legal and psysical custody. Once results come in he can ask for visitation,

Go to ur court house, ask where family court is, then u go to window, tell clerk u want to file for custody and child support, and u will need a fee waiver, u fill everything out they give u a copy to serve him, u can have it certified mailed to him... they will give u a mediation date on the paperwork and a court date... if he dosnt go to mediation u can just go and tell them situation, then go to court the judge takes the mediators recomendation and usually goes with that, that's. When he does all the *ordering*

It really depends on judge, my ex got full custody for 6 weeks because he went to court by himself and I wasn't served at all, he showed up with police and I had to hand him ovr Dean was 3 and had never met him before...

It was hell, that's when I got a lawyer and she told me because no custody order was in place it was that much easier for him to do it, I didn't even think I needed to file because his dad wasn't on bc, but once I did the dna test that's all he needed to go to court... cost me 5,500. And 6 weeks to dis credit everything he had said in court when I wasn't there...
Even if he dosnt come to court or ask for visitation, at least ur ass is covered, once I asked for cs, that's what got him all crazy and wanting custody, the more custody they have the less he will have to pay..
He had him for 6 weeks and I smurf u not he filed cs on me on me  

Now we have 50/50 legal custody and 30/70 physical he gets him everyother weekend and I don't get cs, we made deal I wouldn't sk for cs or med insurance and Dean would keep my last name.

U can file now, he will get papers, and he can respond to what u put down, if he protests and asks for a dna test, the judge will order it... and they will send u the order, u will have to take baby down there and u and baby will give dna swabs...

Did he ever sign the declaration of paternity??

File for child support first, that will get the ball rolling. Paternity has to be established he will be given the opportunity to accept or deny it. If he denies it he gets a paternity test. Some states make you get a paternity regardless if you arent married. If she's living with you, you basically have what is full custody I believe but maybe you do have to file for that. Him paying child support doesnt have to anything to do with CS. He has to file for visitation and if he does it will more than likely be granted.

Does he file where he lives or here where she was born?? How can they give him visitation if they've never met??

Where he would file for visitation idk, call your local family court to see. I know child support can be filed in your home state regardless of if the other person lives out of state. He can get visitation because he is the father, he has just as much right as you do, sorry to say. The only way the courts wont grant visitation would have to be if he was violent, had drug issues, or other extreme cases, and there has to be proof.

I have police reports from domestic violence (him to me) and emails of him threatening bodily harm to me. He told me to kill myself, just a bunch of crazy smurf. I have proof of it all.
