I know in tx of yoj have a court order you can not make any changes to the bc without other parents consent. My dd bc doesnt have a fatger either.but because I have a custody agreement.i cant change anythinb

in most states as long as he is still on the birth certificate and has rights, you need his permission to change his last name... :-/

But we don't have any contact with him and haven't for almost a year. We have no address, No phone #, nothing.

He will have to sign the paper saying he gives you permission. I just went through the same thing. I have full custody and he has no visititaion and i still had to get him to sign the paper giving me permission to change his last name. and my son doesnt even have his sperm donors last name he has my last name i was changing it to my SOs.

You need his permission.

If he doesn't give it to you, you can go to court to have it changed.

He isn't on the birth certificate. The father's part is empty. The only reason my son has his last name is because I put his last name in the baby's name part of the birth cert.

Look up the laws in your state. I have to have bd consent or he as to be absent for a year. No child support, calls or anything.

Do u have a custody agreement? If you do you will have to go through tge court about not having contact, get his rights taken away tgen change tge last name

then you can petition the court to terminate his rights based on parental abandonment!

Next month makes a year of him being completely absent from my childs life.
