He has no rights what so ever. So I personally just have to go fill out a form and prove he has not been in contact. I have a ppo on him so that's my proof however I'm waiting untill after me and SO weeding to file.

is he is definitely not on the birth certificate and the courts have never seen any connection between the baby and him as a father, for example, have you ever gone to court with him regarding anything about the baby like custody, parental rights or child support? have you ever been on government assistance and name him as the father of your baby? if there is absolutely no government trace of him being connected to this baby then you might be able to go to the court and petition and name change based on the statement, you don't know who the baby's father is... although they may ask you where you came up with the random last name lol...

He didn't sign the birth certificate. We went to court in August 2011 for custody which we agreed on in mediation. I have received benefits and his name has never been on that. He has never paid child support. Again he moved out of the state of Virginia a year and a month ago and did not give a 30 days notice to the court. He didn't give me an address or a phone number to reach him. He moved and fell off the face of the earth. I've been completely supporting my son his whole life and I' am always with him.
The visitation we agreed to in 2011: I got full physical and we got joint legal. He had him on Wednesdays 6pm to Friday 6pm. I would have him Friday 6pm till the next Wednesday at 6pm which is when he would pick him up.

That only lasted a month and then he would start making excuses as to why he couldn't make it then he moved.

Most lawyers have an hour long free consultation. I would make an appointment and see what you can do.

From what I've seen on here, women have said they had to put an ad in the paper and if the guy doesn't respond within a certain amount of time it's considered abandonment or something.

yep that's what I had to do and I also had to hire a private investigator to find him...

I'm going to call the court tomorrow and find out the steps I can take. Thanks everyone.
