Self defense question

posted 8th Dec
What exactly does that include? If someone breaks into my house, can I shoot them? Stab them? Beat them up? Does it matter if they're armed or not? TIA

I want to say that it varies by state...like here in TX I'm pretty sure you can use deadly force if someone comes in your property.

When someone broke into my house about 15 years ago, the county sheriff that responded to the call said that you can shoot them if they are trespassing on your property. You are suppose to shoot to kill though because if you just wound them they can sue you even though THEY were the ones trespassing on your property.

Depends where you live. Lots of states have castle law where if someone breaks into your home, armed or not you can use lethal force.

If you fear for your life you can hit, stab, shoot or kill someone breaking into your home.

You would have to look it up for your state. In my state, if someone breaks into my house or is on my property, I could kill them and it would be self defense. I think it may be the same thing if someone assaulted me in public.

Usually if there is a "make my day" law in your state, you're to shoot to kill.

The last part is the stand your ground law.

We studied a case like that in college, a man was attempting to break into a woman's house and found a week spot in the roof and completely crashed through the ceiling, she had one of those overhanging storage things for pots and pans on the wall a magnetic strip for her knives...well I guess the way he came down he hit the knives and pots & pans. He was able to sue her for injuries. He didnt win but the simple fact that he was allowed to continue to terrorize her like that just makes me mad about our legal system

Indiana has the stand your ground law, basically if someone beaks in to your house or while you are in your car, you have the right to kill him

(i) A person is justified in using reasonable force against a public servant if the person reasonably believes the force is necessary to:
(1) protect the person or a third person from what the person reasonably believes to be the imminent use of unlawful force;
(2) prevent or terminate the public servant’s unlawful entry of or attack on the person’s dwelling, curtilage, or occupied motor vehicle; or
(3) prevent or terminate the public servant’s unlawful trespass on or criminal interference with property lawfully in the person’s possession, lawfully in possession of a member of the person’s immediate family, or belonging to a person whose property the person has authority to protect.”
