That is ONE situation of date rape, the blanket term date rape does not speak to intention, it is quite simply rape that happens between people who are on a date. Any law that wants to consider date rape a miscommunication is a misogynistic law and is exactly the problem.

I was just naming one example. I know there are a lot. Really, statutory rape shouldn't even exist. It's pretty ridiculous that someone can get punished for having consensual sex with someone just because they aren't old enough to 'consent to sex'.

ETA: There should be some gap limit. Obviously 30 year olds should not be sleeping with 14 year olds. But I think someone say less than 5 years older, shouldn't count as stat rape. I don't think a 19 year old/16 yr old, or a 20 year old, 16yr old is really a big deal.

But the question is asking which type of rape is more likely to actually be a miscommunication, it's obviously date rape and rightly so.

I know what he wants to hear, I know what the "right" answer is. However it is not the right answer, and is in essense the absolute problem regarding the discussion of rape. I refuse to answer it. Its misogynistic and an archaic form of thought. It is rape apologist philosophy.
