This is a matter of opinion, yes my opinion, but, children need both parents.


I do think having an open case already won't help your situation any.

You need to call a lawyer and write down everything he's done/ said while it's fresh in your mind.
And don't let him see the baby, bcause he could take him from you and refuse to give him back in some states.

im not letting him take my son anywhere, and im not going to go to him to let him see him beucase i don't want to be anywhere near him. i don't have a recording of him telling me i won't live to see my son first Bday but i do have text of him saying your dead and that he is going to take my son will that hold up with the police?

My dad was a drug addict. I definitely didn't need him. Children needing both of their parents is circumstantial. Sometimes they are better off without one.

While I agree with the other ladies remember to file with a reason for withholding, his lawyer could use that against you. Trust me.

You already have an open case with CPS and they have not taken the child therefore they don't see an issue in the home. So that threat is out the window.

Record his threats and get a RO on him

Since you and him are not married he will have hell to get the children from you.
First he would need a DNA...then prove you unfit. Also he would need to show he can provide better and be current on his child support. That could take years.

At best he could put himself on child support after the DNA test...Get current on whatever back pay he owes you and request visitation.
But if there is a RO he wont even get that.

Yeah imo you should go down to the police station right now and get a protection order.

Not true at all. My friend had a RO against his ex wife for using drugs and driving with their daughter multiple times and her being abusive (he has pictures of a handprint on his daughters butt) and she still got her.

I thought I was the only one who noticed that.. so again I'm left wondering what happened there.
OP- I wish you the best, but I feel like there's more to this story than what you're typing out. I hope things work out for the children in the best way possible.
