need answers ASAP please!

ok so here is where i am at right now i have 2 children with my ex... well we have been going thru custody ish since june... its a huge mess anyways we have joint legal joint physical and i only have them week 1: wed-friday week 2: friday-sunday so i go a whole wee with out seeing my kids. ( temporary orders) i also have a case pending against him for what i thought ws statutory rape but the DA informed me that it would be child molestation against me. i was 14 he was 24 im 20 mow and he is 30 and me being 20 i wouldnt even be with a 25-26 yr old, that is just where my head has gone in the 6 years ive had to grow the smurf up! anyways i get food stamps and cash aid & he has only paid $50 in childsupport which was in october ( our kids are 4 & 2) . anyways i didnt get my benifets today so i called to see why and she said oh we got a report that you no longer have the kids in your care!!! uhm WTF i still have joint everything of them! anyways im going to take a cope of my papers from the court to my worker today.... what are they going to do? am i going to get my benifets taken because i olny have them 4 days one week and no days the next.& will they give them to him!!!

In many joint physical custody situations, no child support is ordered because both parents are responsible for the financial care of the children equally.

That could also be why you are no longer getting food stamps.

well we dont have 50/50 which is why he is paying and riverside county is super strict on child support. and he owes 6000 in back child support just the last 2 years thats not counting the the other 2 years from my son! and my foodstamps is also just not on cause of my quarterly report...

where im from which ever parent has the kids i think 90% of the time gets childsupport ect and as long as he doesnt apply for food stamps ect then i think u should still be able to get those along with taxes too if u have the kids more days a year (overnights too) then u can claim the kids not the other parent cuz who ever has the kids more is obviously spending more to take care of them my sons dad sucks at doing anything right he got like 8 days ( specific hours ) with his kid and didnt ever take care of him those times or pay CS ect so things were a little easier for me GOOD LUCK!!!

What I am confused about is why are you trying to press charges now against him? So you can use the kids against him? I could have read that wrong, but if your pressing charges against him cause of child custody your effed up!! If i am wrong about what I read I apologize

Tell me about it. It's a smurffy situation in general. He shouldn't have been with her at 14, I agree, but she was with him long enough to have 2 kids. Unless she was being threatened I don't think she should be allowed to come back to file charges. But they give women 10 years to report it..

5 years here if it is rape..I dont know about stat rape..Thing is she is making it seem she wants him to go to jail so she can get custody of their kids. That is not right. Thats smurffy and immature and karma is a bitch. If he is a good father let hiim be. Its seems they were together for awhile

oh smurf im sorry i was in a hurry earlier no thats not that case haha no i didnt just press charges and i have never tried to keep his kids from him EVER.. i have actually pushed him to be more envolved but the min i needed help he literally took them and 3 days later was in court... if you girl could see these papers... oy vey my response papers have always been based on a 50/50 meditation schedule so always always been fair to the children and him! visitation is not for the parents its for the kids and when my kids cry when they leave me and beg me to stay another night after just 2 nights of being with me, i cant be nice after so many times of my kids crying. not to mention all the smurf their father and his family have dont. domestic violence when to call the cops he broke my phone made me stay in the room. they stold my car, cops said civil matter (no money for court) kept my kids from seeing and calling me... its a HUGE mess!!! im going back to court soon and im hoping we can go back to the old 50/50 we had untill my son starts school then i would like to have him during the week and his dad can have him weekends and a few days during the week (not over night due to distance) and half of all holidays!... well see im getting an attorney in the next month!!
