Murder Question.

I was watching Solved on Netflix last night, and a lady got murdered. Turns out the woman was 5 weeks pregnant. So, they automatically made the case a 'double homicide'.
Let me make this clear as I am NOT trying to cause any drama or be insensitive, (I am pro-choice), but they don't charge a mother with homicide when she has an abortion that early, so why would they charge the murderer with a double homicide? I don't understand.

Maybe because that child had a chance to live if the mother wasn't killed?

I don't see how they could. They didn't know if it would have even survived, whether the Mother would have chosen to keep the baby, etc.

Fetiscide is a crime. But abortion is not.

It's because the mother had no choice. And it's considered a life by court standards. With abortion, it's the mothers choice. Therefore, it's not murder.

Becusae the mother didnt choose to abort the baby. Someone killed her AND her baby.

If a fetus is considered a life and its mothers choice to kill the baby, then women shouldnt go to prison for killing their kids at any age. lol. Its messed up.

Possibly because the mother has the choice to abort her child, and in this situation, the mothers choice to chose life for her child (and ultimately herself) was taken away?

That's different. Aborting a fetus is not murder because it's the woman's body and her choice whether to carry it out. At fetal stage, you could argue 'cells', 'its not breathing yet', technically, its just a parasite/organ in the mothers body. But a living breathing child that can't defend themselves... that's not only murder but cruel and unusual punishment.

Now if a murderer kills a woman that's pregnant. He not only took her life, he took away her choice and the babies chance at life. Granted, usually they don't charge double homicide, usually it's homicide and involuntary manslaughter.

That brings up a good question... now what if a mother decides to abort and the father of the baby doesn't want the baby aborted? That isn't considered murder, because it's the woman's body. But it takes two to make a baby so shouldn't he have some say in the matter as well? I am just curious of this sort of loophole, because I have always wondered that.

In that case, I think it comes down to women's choice. It's her body. If she doesn't want it, she shouldn't be forced to go through with it. Yeah, it takes two and this is a hard situation because I know someone who went through this.

Just makes you wonder ya know, carrying a baby is one of those things a lot of people never get to experience and honestly I am sure if a man who really wants a child could carry a baby they would as funny as that sounds.
