Can he get visitation?

Okay, so please dont judge i just want some advice. My daughters sperm donor is currently in prison, serving an 18 year sentance. My boyfriend, he has been here since day one, as far as we are concerned he is her daddy. I just got court papers saying her sperm donor is taking me to court for a paternity test. Is there anyway he can get visitation while hes in prision? I currently have a court date awaiting a restraining order, due to him threatening me saying hes going to send people after me, put my bf in a hospital bed etc.

Uhh... he's in prison, how the hell did he even send court papers lol? I seriously doubt it.

I don't think so. It doesn't sound like he has a very good case anyway.

I highly doubt it. What the heck would you have to do to get 18 years? I;m going to assume something that would rule him a danger or something - even then, I doubt inmates get visitation.

It's unlikely, considering the length of his sentence and the lack of prior contact. I doubt they will see it as in the best interests of the child.

If you can get the restraining order to cover your household there is no way! Tell them that he has threatened your life and you are the only person that could take your child to visit with him, and since you are filing a domestic charge, and she is a minor she should be protected.... Not sure though.

No judge is going to give visitations to someone in prison! She would have to go to the prison to see him!

Im highly doubt it

In Idaho being in prison for more than 6 months gives me rights to request termination of rights.

Does he know that your filing a restraining order, if so he's probably trying to get back at you or trying to force you to see him. Honestly I've never heard of anyone requesting visitation when in prison. I'm assuming that the judge probably won't grant him it

Inmates can send out court orders. My friend's bd sent out papers disputing child support also. As far as visitation goes though I find it highly unlikely.

Maybe if youre lucky he's not disputing visitation, rather he's disputing paternity. But no, he wont get to make a child go to a prison to see someone who's going to be behind bars for the majority of her childhood

Second time felon, robbed a store and led them on a high speed chase..smfh. But being that he was just sentanced in march, and i just had my daughter in july, he wont get out until shes 18..
