Yes I have known him for 7 years. He's my ex's moms friend who has always take a liking to me and helped me whenever I needed it.

I'd say go for it.
It will be scary, but I promise you, once you're comfortable in a new place and don't have your BD hanging bullsmurf over your head you will be so happy and more refreshed.
Your daughters will benefit greatly, even if your BD decides he can't be bothered to see them.
You will have the opportunity to meet some new friends and gain full control of your life  

But yes, a contract would be necessary.
