Step one after kicking him out would be find a job. I would want to make sure he could not use you not working (and therefore having no money to provide) as even a potential excuse to seek custody.

That is good. I don't think the judge would use that as a reason with the recordings you have, but just to make sure I wouldn't even give him that as a potential reason his is better equipped.
