Which puts a burden on the fact it could be charged as such. You now have a measure of what a solid portion of parents do, so it's harder to argue with gross negligence. But you are correct there are times when people can get away with criminal acts based on the sympathy of the jury.

That's another thing that bugs me.Toddlers are top-heavy,why if she was taking the risk of him falling by placing him up there,would she let go?

Something else that bothers me..I think the only reason so many people have so much pity for her is because she was his mother.After reading through the responses I have a better idea about why she wasn't charged with manslaughter.
But if she had been his teacher or his nanny,pretty sure the legalities that might hold a prosecutor back wouldn't matter and they'd find SOME kind of why to hold her responsible.

You can't say she would never be charged in any state. I seriously believe she would be charged here. I've seen parents be charged who were far less to blame.

Can I saw never with all certainty,no. But it's pretty unlikely that too many district attorneys would have the belief that the statue would apply in this case. It's not even likely a judge would find cause to procede to trial if they did.

She's 14. Obviously she was scared to tell her parents.
If the baby got stuck and she tried to get it out by using scissors, I don't think she meant to kill it. She was probably in pain, freaking out and not thinking rationally. Which is what 14 year old children do.
