Victim blaming D&D

What do you think of the practice of bringing women's sexual history into rape trials and making her seem like a "slut" to try to prove that she wanted the rape? Does age matter? What if the victim was only eleven years.old when she was gang raped? D&D

It's obviously wrong and should not have any bearing on the case, but unfortunately, there are too many people willing to adopt the victim roll to compensate for their own poor choices.

I don't feel like it should be allowed. Bringing up her sexual past is basically saying "she was asking for it" or "she made it up". If she has a history of yelling rape falsely then obviously that is relevant to the case. A woman/man with a lengthy list of partners really has nothing to do with a rape case. Rape is rape.

The problem with rape trials is the victim is more focused on rather than the accused defendant.

An eleven year old girl who was videotaped being gangraped by a group of adult men is a victim IMO.

It is a complete double standard, it is the ONLY crime where this happens. Take someone who has been violently assaulted and stabbed after arguing with a friend. Even if the victim had started the argument, was literally standing there shouting "do it! do it!" no one would say well he was asking for it. They wouldn't drag up the history of arguments he had with people and turn around and say well just look at him, he's so argumentitive, he's walking around arguing and provoking people non stop so really what difference does it make that he got stabbed. No that doesn't happen, it doesn't make the stabbing any less of a crime so why in a rape case?

Sounds like it to me, but without posting specifics in your OP, my post was generalized based on the topic.

I am NOT talking about the specific case you linked, BUT I think the info may be relevant in rape cases that are date or acquaintance rape situation. There are crazy women out there that accuse men of rape when it either didnt happen or was consensual.

It disgusts me.

I could sleep with the entire town if I wanted to. Does that suddenly mean I'm incapable of saying no? Is my body suddenly free to anyone because I've had a certain number of sexual partners?

I don't know how that attorney can sleep at night. That's nonsense and that girl endured enough pain without having to be called a "spider".
