Changing babies last names

I would love a Florida mom's input but anyone would be good. This will be a post and run. What are the chances that I can change my kids last names to my maiden name?

I am getting divorced and I think I want to change all of our names to my maiden name. He isn't involved whatsoever and I can't stand that we all have his last name. Is there a way that I can petition for it, can it be changed and have my ex stay on the BC because he's clearly their father.

You might need his approval but idk.

You both have to agree, I believe.

My daughter is 4 months and my son is 16 months

Both parents need to agree. You can take it to court if he declines, but you'll need to prove why changing their name is a good thing for the children.

I'm not positive, but I *think* I have heard before that before they are a certain age you may change their last name. But I'm not sure lol

Because they aren't in school, it will be easier....but you still need the father's permission or you'll need to go to court.

My So just got divorced his ex wife could change her last name but the child was required to keep my SO last name. He does pay child support.

I just did this a few months ago in Ohio. We are required to ATTEMPT to get the consent of the biological father and put an ad in the newspaper stating that you're going to change it and if anyone wants to oppose, they can show up at court. check your county website, they should have directions with the application.

Divorce is different. Im in florida My SO just got divorced this year. His ex could only change her last name not the childs.

ok. well i made sure to include the fact that i was from ohio.

im listening on this ,.,,,,im from fl too and im NOT NOW NOR HAVE I EVER BEEN married to my sperm donor but i was dumb enough to put him on the bc and give her his last name we broke up when she was 4-5 months and he doesnt pay anything shes 14 months now ..id LOVE to change her last name to mine

U MIGHT beable to because of law for him not being in her life but I know with divorce they would not allow my SO ex to change the child's last name.
