is this fair? (child support)

posted 26th Nov
In light of recent events, BD and I have decided it's best we come up with a parenting plan. I make very little money, I waitress at pizza hut, and go to school. BD makes average 5k a month. SO brings in 4k a month, but works out of state so he has expenses out there too.
I would pretty much have full custody of K. Split holidays, I get him part of the day, he gets the rest of the day. And whenever he's in town he gets K. Which is around 4-5 days every two months. I pay for health/dental insurance through work.
And he agreed to pay 100 a week. I don't want to be greedy, but insurance is expensive, especially compared to the amount of money I make personally, on top of other expenses for LO like diapers, clothes, food, and so on. Also there is no daycare expense, SOs mom runs a daycare so she watches him for free.
He hasn't paid CS at all, so at this point I'm truly happy he wants to start now at all, so does 100 a week sound about even?

My BD and I have joint custody with being primary. I get 209 a month in CS for one child. They split our wages, etc.

I'd be asking for more, especially since he makes that much. Since you're making your own, can he get in trouble if he doesn't pay it?

Did the courts determine it?

making 5k a month he should pay more... if you were to go to court he would be ordered to pay way more. thats not even 10% of what he makes.

I'd ask for more..like $600-$800 a month. $800 would be 20% of his take home pay. That seems fair based on his income.

It sounds fair to me!!! and I agree take what u can get, my Bd sends me 200 $ a month -___- we don't have custody or child support agreement though, sometimes I feel like I don't even want his money cause he seems to think that's what makes him a "good dad" he's only seen my son twice -___- ughhh

I'd ask for more, only because he makes a decent amount each month. Plus, if you did it through court, they would make him pay more.

I thought about asking for more but didn't want to be greedy. I just want help in general so I don't always feel like I'm drowning.
And for those who asked, we are having it written up and notarized through a lawyer and it will be written in that if payments and other "rules" are not followed I will bring him to the courts and have it all made through them.

If he doesn't follow the payments and guidelines on the document we are going to have notarized, I will bring him to court and they will order him to pay almost 800 or so a month, so it's in his best interest to pay this smaller amount.

here in MN they have an online child support calculator which is helpful-it is not like it used to be especially if the father has the kid 40%-I would get almost nil since I work full time.
