ok legal question..HELP!!

ok so my kids sperm donar and his attorney are ass holes.!! his attorney is a family friend first of all should totally not be allowed in court!!! anyways ok my kids father had primary physical but we have joint physical and legal. well the only reason he has this is because they used my prescription ( xanax) i was taking against me! i was not taking it over what i was prescribed i was actually taking it less. well they used that in court along with slandering my name in various differnt degrading (sp?) ways.. well i called CPS on my kids father cause my son came home with a busted face (fell on his bike) but had no visible scrapes on his hands knees or elbows showing him trying to catch his fall (natural reaction to falling). well i talked to the worker and i explained my whole situation and that i had been on xanax and he was using that against me. she then made me aware that they can not use any medication sgainst me in any case espescially mental health medication as long as i am not abusing it, it is in my name, and i can carry out my expected duties as a mother. so i feel like i could have a law suit in the judge and attorney and also the mediator for using my prescribed medication in assist to slander me as a mother without any drug test or anything being done and all being just hear say...

my kids dad has done multipal things where i have had to call the cops and one time he left a bruise on me he grabbed my phone and broke it and wouldnt let me out of my room.( that was a long night) i never did anything about it later cause i figured it was too late and now years later it really is.. well him and his parents put their name on my car and said i gave it to them!!! i had to call the cops at least once a week and finally a month later got my smurfing car back.. his mom also used to grow week not is a locked room in the house me and my son lived in. and she also has fraud on her name and now some smurf like they wouldnt pay the last apartment they lived in so they had to be taken to court before they actually would move out.. ehh this family is a smurfing mess!!!


i need help getting my kids back since i have no reason why i should not have them in my primary care!! IM MAINLY CONCERNED WITH THE FIRST HALF OF THIS POST PLEASE HELP!!

I would have done this and aske these questions before my kids got taken off me

First of all, they can use your prescriptions against you. DH was recently summoned to court to testify on his ex wife ability to parent while taking medication. The attorney being a family friend is also irrelevant, if the family friend was a JUDGE he would be required to step down from the case.

i didnt have the chance or believe me i would have!!! i asked him to pick them up on day before his visitation day cause i was bleeding and was going to the ER in the beggining of this pregnancy, and that tuesday (was saturday when i called and asked him) i was in court with my kids in his smurfing hands!

Being married to someone with a criminal record and being on probation is not going to help your case.

for what medications? and did any one get drug tested? and did he get stripped of the kids vissiting times cause of it?

This. Get a lawyer u really should've had one esp w family court. And I know here the father can keep the kids til court if that's what u meant. If u don't have any abuse stuff on record somehow to prove it they won't really consider it.

they know nothing about who i am with! nor will they! your good at living up to ur name hehe

She was on Xanax. I do not know if she got drug tested. She lost full custody and it went to shared parenting.

oh im sorry i misread haha i was asking if he did hah my bad.. did she give reasonable cause to worry ? im asusming so! oh i forgot to add he has had a child support case open against him not from me but the county. he owes $6000+
and has never paid a dime. he has never wanted to help with money him and his family are greedy lying people which i am guessing he wants tthe kids so he doesnt pay child support and so he can get food stamps and stuff. also my son is 4 and daughter is 2 this didnt start till june when he found out i was finally happy and having a baby with someone else. so why did he wait 4 years and 1&1/2 years if he felt like i was bad for them... i had to make him see his kids...

Well I sure hope whoever you are with is safe for your children. It obviously sounds like you don't want the courts to know about him...

smurf i can go on for days about him and what he has done wrong but i dont ever get enough time in court! his attorney never lets me speak

oh no i meant my kids father wont know about him he has sabotoged every thing i have ever had including my relationship with my mom at one point. he cant stand me happy and with anyone but him... and i wont have him make me unhappy again by letting him in my relationship like he tries to do!

i dont mind if the courts know about him in fact they do know about him so does the mediator but i wont give my kids father any personnal info but the court handleing out case has all of my SOs personal info !

Bc when it comes down to it courts want proof and facts. They don't wanna hear he said she said. Just get urself a lawyer. He's got one. U should have one.
