Removing fathers rights

posted 24th Nov
My ex had an ex parte issued against him by his wife for adult abuse. Can this be beneficial in trying to have his parental rights taken awayk? Along with his history of not paying child support and not visiting Jude in nearly a monthk?

I think he. Has to have no contact for a year, before you can file for abandonment/removing his rights

In some states it has to be 3-6 months of no contact, emotional physical or financial, to be able to do that.

He would have to consistently not pay support and not have any contact with the child for a much longer period of time than a month. Also, courts don't generally take away a parent's rights unless there is someone else (i.e. a stepfather) willing to adopt.

I don't know about the abuse, since it wasn't toward the child.

My oldest daughter's "Sperm Donner" has not seen her in over 3 years and has not paid any child support in about 4 years and he still has rights! It sucks I know.

Actually you can have his rights severed in most states. In some you need someone there to transfer them too however.

No because its a 3rd party dispute, and would not be admissible in court most likely.
