hi need some advice

posted 23rd Nov
My daughter is 6yrs old. me and her bio dad got married before she was born. Three weeks after the birth of our daughter he left. The last time he has seen her she was 9 months old. Well my current husband and I have been together since she was 6 months old. After her real father spent the weekend with her, he left. we haven't seen or heard from him since she was 9 months old. Well out of the blue, her bio dad calls me telling me he wants his rights. keep in mind he hasn't paid a dime in child support. haven't been able to find him. I told him no, because she has no clue who he is. My husband has been raising her since she was a year old. We haven't even told her about her real dad because she won't understand. She has adhd and severe anxiety. So that's why we wanted to wait till she got older. But he has told me that i have no choice but to let him see her. Im confused and don't know what to do. Can't call a lawyer until Monday due to the holidays. The sad part is that my husband has been wanting to adopt her.

He can't just come and take her, so don't worry about that. He does still have rights and if he goes to court, they will let him have visitation. But he will have to pay child support. Even with him gone for that extended period of time, it would be so very extremely difficult to get his rights terminated, which is what you would have to do to have your current Husband adopt her.

unless you have visitation set up you dont have to let him see her. but you need to tell her about her father she has a right to know

You could let him see her but in a public place with you and/or your husband there as well. You could even talk to him about letting your husband adopt her because of his extended absence. It is 100% fine to not let him see her.
