Father's rights?

SO wants to adopt my little girl, but we're so confused on if we have to get permission from her bio dad. Her bio dad is not on the birth certificate and has never met her. SO thinks we have to have bio dad sign over his rights and give permission for SO to adopt, but I don't think so. We've talked to some lawyers and some say SO is right and some say I am right.

Does SO have to get bio dad's permission to adopt my girl?

If he is not on the bc and has no rights by the courts then, no. Ask for a paternal affidavit and say that your so is the father

i thought that if the bio's dad name wasnt on the birth certificate than you didnt need his permission. I could be wrong though

Yes you need his permission because he needs to give up his rights. Also I believe you have to be married, not just dating..

if he is not on the birth cert then he has no rights. By never having his name put on the birth cert he never claimed his rights so he has none.

I've done the affidavit. They did it no questions asked.

But on the other hand, if there hasn't been any paternity established by the court or anything like that... Why does your SO have to "adopt" her? Can't you just go on with life & say she is his child? You can even do a new BC & add your SO to it.
Or does the bio father pay child support, see her?

Nope. They said people do it all the time. My son was 3 yrs old when it was signed. All we needed was ID and to sign the declaration

Bio dad has never met her and doesn't give any child support. I thought if we added SO to the birth certificate he would have to adopt her.

Yes. You did not have to be married to do it. Just say he wasn't around when you filed for the birth certificate or the birth.
