BD didn't show in court.

posted 20th Nov
Court was Monday for BD's failure to comply with a court order (Child support).
I decided I wanted to go to see what was going to happen, cause I really can't rely on much information from my case worker (Long story). He didn't show up, I figured he wouldn't, he avoided the last two court dates (back when it was to establish support) like the plague.
Anyway, long story short, the lawyer told me they're charging him. I forgot whether it was contempt of court or failure to appear, but they're charging him and putting a warrant out for his arrest.
I'm expecting it'll be a while before my case worker will be in contact with me, and I was just kind of wondering how this is going to influence the child support case? Is he just going to be arrested and let go until this happens again or what's going to go on?
Sorry, I know I'm nosey but I really don't like being in the dark on this stuff. I've never been in this situation before.

Did they say anything about a body attachment with the warrant?

I think he would still have to pay the child support. I know in RI, you can go to jail for owing more then 5k in child support.

I think that what they'll do is issue a bench warrant for his arrest...and if he winds up going to jail, his arrears will still accumulate. So if he gets a job (I'm assuming he doesn't have one now), they'll just take his payments from his check plus extra until the arrears are paid.

I don't recall so.
He told me that's all the information he could give me and to contact my case worker, but yeah, it's a bitch to get ahold of her, she's been my case worker for months and I've never spoken to her and not for lack of trying.

they are probably charging with failure to appear and once they get him in custody what ever his bail is may go to you... I know for our contempt hearing he got locked up and was ordered to pay 2000 or spend 60 days in jail. maybe you should call tomorrow to find out what exactly will happen..

He will probably go to jail for a little while and then have to back support on whatever he's missed. If not then I'm not sure

Oh no he has a job, he works at UPS.
I called last Friday before court and informed the case worker via voicemail (I hope she listened to it). He's been employed for a few weeks now, and had sources of income for months, months, and months before that.

In Ohio they will keep him until the next time they can put him into court. So like if it's on a Friday/Sat, keep you until Monday for court, or any other weekday, will keep you until the following morning.

They can't keep you in jail for not paying, as I understand it. Only issue a warrant, to cause you to go to court for it.

What's the point in keeping someone in jail anyways for that? Like them being in jail is going to give anyone a chance to even make money for their kids.

Ahh my buddy said I just need not to worry with it lol.
I mean, he's straight up told me that he's never going to pay me a dime and quit his $10/hr job when I first filed for child support, but now that he's got a girlfriend with expensive habits (Eating out, smoking, shopping, etc) as well as his own *Coughcocainecough*, he has to get a job.

The warrant is probably for failure to appear. If he has a body attachment(which is what they normally do in Indiana) if he convinces someone to bail him out, all the bail money goes to you

Honestly with him, jail is the best thing they can do.
He thinks he can get away with this smurf, he thinks the law isn't applicable to him. I mean, straight up, last Thursday he messaged my husband's facebook and TOLD him to TELL me to call the judge and have the judge call him because he couldn't make it to court Monday, he has allergies.
He's told me a lot he will never pay me a dime, quit a job when I first filed, etc. He needs something to snap him into reality and to realize he's accountable for his actions.

I think they do something like that here in Arkansas. But I know here you will definitely go to jail for not paying after a certain period of time, which causes more back support to accumualte, and then they garnish your wages and taxes

Oh wow, really? That easy?
The money won't be going to me though, me and my mom came to an agreement and decided that the money should go into LO's savings account for college. We both thought it'd be best since DH is in a good position with work right now and we can afford to do it.
