could i press charges. custody agreement.

hypotheticly, If my ex were to violate our custody agreement would I be able to press charges given our situation? Situation being his girlfriend, who is facing serious charges including criminal child neglect (which she has already plead guilty to) several counts of child abuse on children ages 3, 2 & 10 months. as well as suspected sexual abuse & failure to report abuse. Our custody agreement states that my ex must take his visits outside of the home they share & ds is not allowed in her presence. this is by my order as well as social services & the judge. Should I catch them together, would I be able to press charges against my ex? Just something I was thinking about.

Hmmm, idk about pressing charges, but i'd think you'd be about to petition to get his visitation taken away or something like that.

I think you might be able to because he is allowing the child around her knowing its dangerous and that she's not even suppose to be around kids by law.

he hasnt so far to my knowledge, it was something i was wondering about because it seems like we keep having to go to court over this issue, because for some odd reason he wants her around my 2 year old, when she isnt even allowed around her own children.

Every state Is different but I had a similar situation with my ex - he was held in contemptive court and had his visitations taken from him as well temporary sole custody granted

You can press charges against her because she is not allowed around kids due to her being a risk and he could possibly be implicated as he knows that she should not be around kids so would be intentionally putting his son at risk.

Best advice: ask a lawyer.

well, i dont know about 'pressing charges' but i will say IF you catch them together you need actual proof. I tried doing that but the cops couldnt do anything because they didnt physically see it..
So have the cops show up OR take a picture.
I do know if they break it, you can take him back to court and have it be 'supervised' visitation.
but as far as pressing charges, i dont know.

you would file a motion to hold him in contempt of a court order. The judge decides fines, visitation, or jail time are possivlities. But you would have to be able to prove it.
