So I filed on my own without a lawyer for custody of my 4yo daughter...The hearing is coming up and I tried to talk to BD tonight about how first there will be a conference to see if we can agree before it goes in front of a judge, so he says its gonna have to go in front of the judge and I ask why and he said he wants 50/50 custody and hung up on me..I'm livid.. He will be lucky to get unsupervised daytime visits IMO! Or so I'm hoping..
He is on probation right now, for an incident last year where he got on heroin really bad and was considered an accomplice to burgarlaries and what-not.. He's been to jail 12 times or simple assault (against me when I was pregnant) and then drug use violations of probation. I have witnessed him being high around Chloe and I mean HIGH, on opiates of some sort. Do you think its possible for him to get half custody? I think this is probably a dumb question but I'm freaking out right now

I'm freaking out because I can't afford a lawyer...and I just don't know how to present all this info to the judge or he will even allow me to...

I dont know how any of this stuff works but im sure they can look him up or even if you show them YOUR proof, he wont have that chance

Most judges will not give 50/50 because it is a common thought that it is in the best interest of the child to have one main, steady home.

So even if he was a picture perfect father, he most likely wouldn't get that. But now, I really don't see it happening no matter what.

U have to have proof with out proof ur sol.

This is untrue. Judges prefer 50/50 so the child can keep a bond with both parents.
I recently got divorced and spent thousands. We both are perfect parents and had to come up with a parenting plan that gives each of us equal time. It has worked well.
While this is not the case for OP if he is on probation.

I can pay to get the police reports from the arresting officer, and I can bring his arrest record from the web inmate lookup

OP, does your city have any legal aid available? Does he have an attorney?

Can you get a state attorney there? I know down here they have them for people who cant afford one.

My state doesn't even do 50/50 custody. Only in the "rarest of cases".

No not for custody

I think that without a lawyer your chances of supervised visits are slim. This is just based on my own experience but until I got a good lawyer my case looked bleak even with my ex having an extensive criminal background and documented history of abuse. The judges didn't even seem to care until I had a lawyer handling the case for me. He was trying to get me on absurd abuse charges until I got a lawyer and the judge threw them out.

I honestly doubt he has a chance of getting 50/50. Especially with his back ground. My friend had go threw a custody battle and once they found out he had past that included drugs. His case got shut down pretty much. He only sees his son once a week supervise for 2 hours. Not saying all cases end up like this , but thats how her case ended up.
