He was also considered a gang member by the authorities and has racist tattoos from head to toe, not to mention he can't find a job and hasn't worked in over 20 years. We went to court and he got 50/50. By the way, I am a full time student, work part-time, and have no history of drug or alcohol abuse, along with no record. I ended up getting a lawyer, because I wanted to move out of town to go to a University to further my education, and I ended up losing still. I even went and asked for another judge to look at our case, a woman this time, and she ruled the same way. I was told by the judge, that if he was good enough for me to have sex with and have a child with, then he is good enough to help raise my son. I'm sorry if I seem like a downer, and I really hope everything works out for you, but from what I have been told, fathers are getting as many rights as the mothers nowadays with their children. My husband even failed 3 mandatory drug tests through the courts and didn't lose custody. He just had to attend meetings and go to parenting classes. I think it makes a big difference on where you live too.

And does it matter that he doesn't have a car, nor license, and he lives with grandma and there is no room for Chloe to have a room there.

Nope. Car means nothing there public transit and he can walk, no room may be an issue when she's older, a y why would it matter who he lives with.

The car probably doesn't matter, but he will be required to have a room and all necessities for her.

And I have no record what so ever except for a couple summary offenses like harrassment and disorderly conduct...
BUT there is some incriminating texts I have sent to BD in the past regarding drug use from me... So can he actually show a judge text messages like that?

No car, no job, and a squatter in our old house which I stopped paying for when we split.The judge makes me pick up and take my son to pre-school everyday, and then to him afterward on his days. It sucks. My son is now 3 and a 1/2 years old and is starting to show signs of aggression and confusion from the whole mess.

Oh, he was your husband?? That makes a difference too I believe, doesn't it?

It might make a difference, not to sure. But that's my story. Good luck with everything. Watch what you say to people or write, because he can use it against you, and when your in court, remain as calm as possible, otherwise it will look like your unstable.

i just went through a custody battle he had a free lawyer and i had to pay for mine it lasted for so long ended up costing me over 4 grand and nothing was done so i dropped my lawyer i had lots of proof my my ex being a unfit father such as getting high, living in a nasty house, even pics of my kids, with stiches, broken leg,etc. and i still ended up having to do 50/50 said it still wasnt enough . really just depends on the lawyer to. they said if anything else was to happen then i could report him. but he is being alot more careful about me finding out stuff good luck. maybe your state will be different.
