Talked to a lawyer today..

With DH, to get his BM served with papers for child visitation and child support. Since his BM isnt letting us see carmen anymore. And im so happy we are able to do this! His BM is being ridiculous! Like-before DH and i got together (and before his BM got engaged) DH was getting carmen fri-sun every other weekend. Then she got engaged. And he was getting her fri night, and having to take her back sat afternoon. And now-we dont get her at all (he still gives BM child support and still asks to see carmen, but she says no)

Well, the only reason we havent done it sooner-is bc we were trying to get his residency papers first. But our lawyer told us that isnt even an issue. So we're going ahead with it. Its $1000 total for the lawyer. Which isnt bad, considering we're paying close to $8k for our immigration lawyer.

Anyways, i think DH is payingher sometime this week to go ahead and get the papers drawn up so he can serve BM with papers. And she is going to be in surprise with how much hes going to get to see carmen.. (Being as she thinks hes still only going to get to see her once every other week) Also, the county she lives in, looks down upon it when you keep a child fom the other parent. So its only going to make her look worse since shes keeping carmen from DH... Im just so reay to get this over with. DH is so loving and wants to be in his daughters life. And he deserves to be. Hes a great dad..

My DH hasnt seen his daughter in 4 months. BM (ex wife) won't let him see her at all now that we are married.

We are going to court soon too. Currently shes in court with her new baby daddy and losing terribly, so we are letting her get smurfed by him first then we are going to come in when her money and spirits are low =)

If the dad is close by, I don't see why he shouldn't get visitation but don't expect a large amount it. The courts don't like to disrupt kids lives. Good luck.

He just wants his regular weekends back. Fri-sun every other week. And time with her in the summer.. Hes not asking for a ridiculously amount of time with her. Just more than 2 days per month. Our lawyer told us standard visitation here, hed get her 31 consecutive days during the summer. And he was so thrilled by that!!

And he def doesnt want to disrupt her in school or anything.

And she lives about an hr and a half away-now. BM recently moved to a new house. And btw-we dont even know where she lives. He isnt "allowed" to know. Which that WILL change. Bc as her dad, he has the right to know where his kid lives. Kwim?

thats good that he wants to be in her life, but don't expect them to tell you guys where she lives at.as long as you have a place to meet and time they wont force the mother to disclose her home address... My sons father doesn't know where we live and they aren't allowed to tell him. we have a place and time to meet.

Here its required for the parents to disclose addresses and phone numbers. Now if they choose not to have DH pick carmen up at their house. Thats fine. But its required to disclose all addresses and contact numbers. As well as where she goes to school (he isnt even allowed now to know where she goes to school)..

Visitation is not considered a disruption. Most custody is dealt with out of court, and if the visitation is low it's because that's what is agreed to. If he wants 4 days one week, and 3 the next he can usually get it.
