Car accident- At Fault and No Fault?

What's the difference?

I was in a car accident, as a passenger, but in my own vehicle. With any insurance, of course they're investigating the accident, but because they can't get a hold of/find the person that was driving my car, it sounds like I may be pinned At Fault?

Which this is the only accident I've ever been in, so I'm quite confused on everything going on.   And my insurance is being absolutely no help, until the investigation is over. They can't even tell me the difference between At Fault/No Fault.  

So, what exactly happens IF it's determined At Fault? What happens if it's No Fault? If it matters, my car is declared a total loss.

At fault means you're responsible for the accident. No fault means you were not to blame for it. At fault means your own insurance pays, no fault means to other insurance pays, or yours does under the comprehensive coverage (if the other driver isn't insured or something).

So I rear end someone, it's an at fault accident. I'm at fault and my insurance covers it.

If I am rear ended, it's no fault, because it wasn't my fault it happened. The other covers it, or my comprehensive covers it if they have no insurance.

If it's seen as an at fault on you or the persons driving part, if you don't have full coverage ins, they will pay to repair the other car only and not yours. If it was the other persons fault, their insurance pays for both cars. At fault or not at fault is easy to determine. Who hit who?

The accident didn't involve any other vehicles, but there was property damage. So, my insurance will be paying either way?

i dont thiink its that simple
we got tboned
and even though we 'didnt give way' because we never saw him
he was definitely speeding
but they found that as it was a country road there was no speed limit on it

so then we were found at fault.
there are so many factors put into it.

They will go after your insurance to cover damages if you are at fault.Your best bet is to contact a local car accident attorney. At fault laws vary by state.

I'd say it would be at fault then. So then it will just depend on your insurance. If you have comprehensive insurance they should pay. If not though, then they don't have to. Liability is only for others damage that you do.

Yes. Since it's property damage, it will be an at fault on your part. They will repair damage to the property and your car

Yes if your policy has that coverage, the property damages will be covered by your insurance if you are found at fault. If your policy doesn't cover it, you will be responsbile for damages. If you are found at fault, your insurance rates and premiums will probably go up unless you have a one time forgiveness clause.

I have full coverage insurance, with comprehensive/collision.

So, At Fault then my insurance definitely pays? And No Fault, they go after the other insurance? In this case, since it's not another vehicle and assuming the other other driver is uninsured, if at No Fault, they'd still have to cover it, correct?

There's no reason that I would end up having to pay out of pocket for my car and my medical bills, since I have full coverage, right?

Nope, you will pay the deductable for the insurance claim and your insurance will cover the rest.

Okay, PHEW.

Then this might be a question you wouldn't know the answer to, but if they determine me At Fault, which my agent made seem like the only way they'll do that is if they determine I was driving (when I wasn't   ). So, anyways, if they claim that, I know the accident will go on my driving record, but will they report it back to the police?

This has been a giant nightmare, because they can't locate the person that was driving my vehicle, they haven't been able to issue any tickets for the wreck. So, I'm wondering if those will come back on me as well?

this is SO STRESSFUL.

Well, they shouldn't be able to site you for it if it can be proven you weren't driving. Were there witnesses aside from you?

Technically, no.

No one saw us leave, but heard us leave (my car is REALLY loud.  ), and realized I was gone. So, it's just their word saying I wasn't driving. And it sounds like that's not enough for them.

So, I'm just worried this is going to be a lot worse than it should be because I ended up in a really crappy situation.
