She should be charged as a child I suppose but the maximum penalty allowed is deserved! I dont care if she doesnt see the light of day until shes 30. What she did was absolutely horrible. Strangling that baby?!! Disgusting. Granted I dont know what her home life was like but there are numerous resources available to plenty of woman out there that do not want a child... abortion, adoption and tons of safe havens if she didnt want it. She could of confided in SOMEONE I'm sure.

Yes. A four year old could murder someone. Doesn't change the fact that he's four. Also doesn't change the fact that it's murder. So what do we do? Where do we draw the line of child and adult? Clearly it's not 18 anymore.

Apparently the courts can draw that line. Regardless she is responsible for her OWN actions. She made the choice to strangle that baby and she needs to deal with what the courts give her. She knew and fully understood what she was doing.
A 4 year old is completely different, most 4 year olds dont fully understand what is right and wrong. I have yet to explain death, murder or anything like that to my 4 year old...how would he know?! Two very different things imo.

It's NEVER been just a straight 18 for murder though. It's always been taken on a case by case basis. If there's willful, knowledgeable intent, and comprehension of actions and consequence, they're fit to be tried as an adult, with proper ramifications. Why is a 14 or 15 year old who kills someone with malice, intent, forethought and cruelty any less deserving of a punishment for the same crime committed by an 18 year old?

I have noticed a lot of us stating if she's grown enough to have sex, but what if she was raped and didn't want to tell anyone?...

ETA: And if that was the case I can see how that would mess that little girl up enough to want the baby dead. We don't know how the child was concieved and she is just a child herself... I don't think that charging her as an adult is right, I do think they should give her the maximum punishment they can give a CHILD though.

I very highly doubt you were aware of those resources at 14. I had no idea about them when I was 16 an knocked up.

A 14 a CHILD is still willing to impulsively so something they know is wrong if they believe they can hide it and stay out of trouble.

She just suffered through an all natural childbirth completely alone ffs. She must have been terrified.
