He wouldn't be able to adopt her unless your ex signed over his rights, and I think you have to be married, not sure about that one though.

I'm not sure about her bio father. But, you need to make a will stating who will get your daughter, how you want your life insurance used (if you have any), etc.. We have to make one ASAP. Last thing I want is my MIL to get my boys, and I know she'd be the first to try.

You should make a will stating who gets custody in the event of her passing.
If there is no father on the birth certificate how are you receiving CS?

This. He can't adopt her until her bio father legal ends his rights and then I'm pretty sure you two have to be married.

Your boyfriend would have no rights to her if he didn't adopt her. You have legal documents drawn up stating your wishes, in the event something were to happen. If her bio Dad wanted to fight for her though, he would be considered, providing he is stable and all that.

Dh and I have all that paperwork drawn up in the even something happens to us, I want to know my children will be taken care of according to my wishes.

At least in my state you have to be married before your so can adopt her. Her bio dad would have to sign over rights to her. More than likely your daughter's biological father would get her

Yeah but even she states in her will who she would like to have custody, can't the bio dad still fight to take her. Since he is paying CS and all that.

The bio dad would get her unless yall married and he gave up rights. If not they would place her with the grandparents before they placed her with your BF

I've wondered this about myself. My LO is 4 and his bio dad has seen him three times. He is court ordered to pay CS but doesn't and owes 9k in arrears. He's a dead beat loser but I'm so scared if I died they'd give my son to him and not my parents.

The courts will recognize who's caring for the child, I don't think it's a default hand over the child to the bio father.

In fact, if SO and BD took me to court for custody, SO would have a better chance of getting it.

OP, here we have "god parents" and it just legally means if you die your child will go to them - but you need to have that legally set up, and I don't know how (probably involves a will).

One question to everyone, since when did it matter who's name are on the BC? Where are these supposed names even written? In the paperwork or on the actual card?

my name and my husband's name are on our son's actual certificate we got from the state.

There's no name on DDs or mine... I remember signing paperwork in the hospital to get the certificate. But I mean, I haven't even hear of someone using the BC as a basis for custody and smurf. I'm in Canada though, don't know how different it is in the states.

What card? When my. Holden were born the got a birth certificate (BC) stating where and when they were born. How big they were. Who delivered them. And who their parents are. My husband and I both had to sign it each time varifying that we are our children's parents.
