Signing Rights Off in California

Has anyone been through this before? What's the process?

im not sure in your state, but its pretty universal that the dad needs to agree, and you must have another person to take over where dad left off to adopt said child and financially support them

if you are refering to parental rights(of an absent/deadbeat parent).....its not possible unless their is a stepparent willing to adopt and accept responsibility for the child.
if u are refering to a parent signing over their right to the state because they cant care for the child then it all varies on the reason....

There normally has to be a spouse (that you've been married to for a specific amount of time) in line to adopt the child prior to rights being severed.

Rights can be severed either through mutual agreement or by the courts finding a parent neglectful, abusive or unfit in some way.

The father of my LO wants nothing to do with him, especially financially, so having him sign anything will be a piece of cake.
I'm single and dont really have anyone to be the other parent.

No, it won't be a piece of cake.

The courts would never allow a parent to just sign away his rights because he didn't want to support his child.

Im going through a divorce and the lawyer who is helping me at the self help center said that the court will grant me all rights and take the father's rights away probably since that is what I'm requesting her father is not contesting it any.

is there any separate side documents that I can get to do that without having to go thru a divorce?

In california YES the father can sign his rights away without another man stepping in. Not every state you do they need somone to adopt. I know for a fact in California and Texas they can do that. Other states I have no idea

I'm fairly certain that it only pertains to visitation and custodial rights, and that until someone legally adopts the child, they are still financially responsible for the child.

I believe this is even more true if the mother is on any sort of government assistance.

Do you have a custody agreement set up? If not you should do that. Go to the self help facilitators office at your local courthouse.

Nope..I know 2 who have done it in Cali and 1 who did it in TX. I was surprised by the TX one.They were married, got a divorce and he wanted to sign his rights away. My friend said it was simple. Kind of weird but there was no issue. None of the fathers have no financial responsibitly to the children. Now I do think the moms had to proove they could support the child(ren) without the help. To be honest I think its stupid that there has to be someone willing to adopt the child
