What can HE do?

Here's the story.
My EX boyfriend has a son who lives with his mom in WA.. we live in Cali. When she moved out of state he got every holiday visitation and summer breaks. They were ordered to 'split' the cost of the flight (they just do the flight separately).. And he pays his child support.
Now, She (the ex wife) is quite the smurfasourous. She has a zillion other kids from other men (ok, 4 but shes pregnant again). They're completely broke and basically she lives off the child support. (for all 5 kids, when it should go to the ONE kid)
Well, she just told him, she doesn't have money for thanksgiving flight.
What is he suppose to do? He eventually wants to take her back to court and try and get him during the school year, since hes getting picked on BAD and he's in a much better position to raise him then her.
Should he just buy both flights and then if she doesnt pay take her to court for it? or what?
I told him, he should buy the one way ticket and if she wants him back, she'll buy one. HAH. i know, thats mean.
hes really upset about it. He pays $800 a month in child support plus his plane ticket. Hes sorta at a loss for what to do.

I would have him buy the flight his way. She can come up with the money to get the kid back. Talk to an attorney

thats how custody of my friends 2 year old is.. if the dad wants the kid he has to pay to fly the kid oit of she wants the kid back she has to pay for the ticket back.

I agree with you... he can buy a one-way ticket and tell her to pony up for the ticket back... something tells me she'll make it happen.
He "could" buy both and then take her to small claims to get his money back, but that's no guarantee. I like the first idea better.

Bad ideas here. Just seen my Brother go through the same. You cannot keep him past the assigned date, irregardless of who has to pay for travel. She can call the Police and have him arrested for kidnapping. He needs to file for modification before he gets there. Then, the Judge can decide.

That's how it was when I was a kid. My dad flew US out and my mom had to Bligh US back in. Needless to say my dad only saw US once.

Yah, he'll have to get back for school, too... but I have a feelin the ex is just trying to see what she can get away with... I have a feeling that if he flies the child out, she'll find a way to get him back on time.

i know you said they are both responsible for transportation but does it state whos responsible for dropping off and picking up

That's what he said. BUT hes willing to drop him off at the airport at the assigned time.. but she has to have the ticket for him... or at least thats how i think

Well his job requires him to work 6 days a week and he used all his vacation up during the summer when his son came for the summer..
He cant afford a lawyer until he buys his house in 5 months.

Well no. He has to have him at her home by midnight of the date specified on the agreement. Regardless of whether he paid both ways or not. It's sucky, my Brother had to do it. Then 3 months later, he got custody and had to pay for them to fly back.

ohh trueee. that makes more sense. but then wouldnt she be breaking it in the opposite way? The son is suppose to be at my ex's house on a certain day by midnight?

She is breaking it. HOWEVER 2 wrongs don't make a right. Your ex needs to follow the custody order to a T or else it will be used against him when he tries to go to court. Trust me, my brother just went through this and won primary custody of his one year old because his ex didn't follow the rules set in place and he did.

Also you said he can't afford a lawyer till he buys a house... Well what is more important to him, a house or having his kid? I would put off buying the house till I got custody.

No, I meant he cant until he buys a house because hes taking a loan out for the house, and he'll be using some of the loan money for the lawyer.. Like, get a loan thats more then what hes planning on buying. If that makes sense..
hes still currently paying off his 401k which he borrowed from so his ex could take her ex to court for HER kids.. Which she lost.. and never helped pay..
SOO frustrating.
