A rapist can sue for custody of a rape baby?

Just saw this on tumblr. If it's true that is messed up...

You do realize that in these states that they make a distinction between statutory and forcible rape, right? A victim of forcible rape will not have to share her baby with her rapist. However, why can't the father of a baby born out of a consenual sexual relationship between a 19 year old and a 16 year old see his child?

Terrible huh? I was reading an op-ed piece written by a woman who conceived a child through rape. She ended up agreeing not to press charges (or testify, I can't remember which) in return for the rapists agreement to not pursue visitation or custody.

ETA- I just reread the article. She didn't end up agreeing not to press charges, but she argues that it could happen.

I don't know anything about it. I just posted it because it seemed messed up and wanted to see what people had to say about it.
