Birth laws

I know some states make it illegal to have a home birth. Any one know where I can find out if my state is one of them?

I know a girl who said she couldn't have a home birth because of the state laws and she's in Florida...

But I don't know where to find out. I hope she was wrong.

Can't you 'accidentally' give birth at home? haha.


I don't understand how it's illegal to give birth at home, that's sad.

I hope so too. My SIL wants to have a home birth and I think it's such an awesome thing.

I don't think home birth is illegal in any state. Having a licensed midwife can be, like in Alabama but its not in Florida.

How is that possible to prove though?

When I was pregnant with DD I looked up every law and didn't come across anything about it being illegal, just laws against home births with midwives present. Florida and Georgia both do not have any laws against home births.

From what I read home birth is legal in 50 states, but it's the person you have assisting that is the issue. Check out Wikipedia to start.

It might be illegal for a medical professional to deliver your child at home, but they can't stop you from giving birth at home

Home birth is legal in all fifty states.
Some states don't allow direct-entry midwives or doulas, but almost all states allow for homebirth with a certified midwife.

I just looked it up (a simple google search) and it is only illegal for midwives to be present in some states. You can have an unassisted home birth in most states but it's about 10 states that say it's illegal for a midwife to be present because they cannot carry malpractice insurance in a home setting.

You can have an unassisted home birth in all states. There's no law against it.
